By commissioning me for custom artwork or using any of my copyrighted material, you are agreeing to the terms of service outlined below. Under no circumstances can my TOS be overwritten unless we've agreed otherwise.

Breaking my TOS may lead to:

  • Warnings

  • Blocking & reporting

  • Blacklisted from purchasing anything else from me

  • Revoking a design or cancelling a commission

  • Legal action may be taken if I feel like my TOS have been infringed severely.

Of course, the TOS may vary depending on what it is. Please don't be afraid to ask for confirmation to see if some of my TOS still apply to that particular occurrence.

| CHARACTERS & PERSONAL BOUNDARIES |

I. My personal characters

I always give people as much creative freedom as possible when it comes to my characters and art. To me - especially my characters -are like dolls I'm willing sharing with others as if they were theirs. you can play with them, interpret them, and have fun with them in your own way!Feel free to interpret my characters however brings you comfort or enjoyment (even if it isn't canon).

Okay to do:

  • Explore and create content freely with my artwork and characters as long as it doesn't cross my personal boundaries (see below)

  • Draw / getting commissioned artwork of my characters to your liking*:

  • Take inspiration from my OCs and content

  • Kin, make headcanons, roleplay* with my characters

  • Make alternative universes of said characters

  • Ship them with your characters or my own other characters for fun*

  • You may edit / trace my character's art for practice / headcanons / edits / memes as long as i'm given credit.

  • Use my characters as coding examples

  • Add my characters to dreamies folders on toyhou.se.

  • Sell merch of my characters if the artwork was not made by me, although I'd like to be contacted first!

*There are obvious a few exceptions. I understand that some people may create content outside my boundaries for personal reasons (coping, personal attachment, etc), however I ask not to be shown or involved in it. If it risks reflecting poorly on me or becomes widely visible enough to make people associate my art with material I wouldn’t approve of, I may request its removal.

personal boundaries -Please don't:

  • Do anything with my characters that advertises personal political beliefs beyond the bounds of fiction, such as anything that promotes hatred against individuals or groups.

  • Create any sexual content that is considered unlawful or exploitative with my art and characters.

  • Steal my characters for profit. No need to steal when I generally allow people to treat my characters as their own ^^''

  • Turn any of my characters or designs into a closed specie. Don't turn my characters into open species either; all of my characters are already open species and you are free to make your own as long as it's for personal use.

  • Do anything that misrepresents fan content as one of the official sources.

  • Do anything that harms my own reputation.

II. DO NOT INTERACT CRITERIA

I am allowed to block anyone that i'm comfortable with without any explanation or warning.
I am aware people will do anything regardless of my boundaries, but I am simply stating what I believe is basic decency.

  • NSFW accounts can interact make sure your content is hidden behind a wall to avoid any minors stumbling across it in my comment sections.

  • I kindly, KINDLY ask not to make weird remarks about my art, myself or my characters as I'd like to make my comment section a civil and safe place for every age.

COPYRIGHT, CREDIT AND USAGE

III. ART COPYRIGHT

PERSONAL ARTWORK / GENERAL USAGE OF MY ART

Okay to do:

  • Take inspiration, although I'd like to be credited somewhere if you believe it may be heavily inspired.

  • You may use my personal artwork of my original characters and fan art for personal use (for example profile pictures, banners, wallpapers, site decorations, personal stickers, etc etc), provided the artwork was created for myself and credit is given.

  • Commissioned artwork is not covered by this permission. If you wish to use a commissioned piece, you must obtain permission from the client, not from me!

  • Permitted use is limited to personal, non-commercial and self-indulgent contexts. You may not use my artwork for advertising, promotion, branding, advocacy or political or ideological messaging and any other purpose intended to communicate or endorse a message.

  • Repost my art and animations, with credit. I do not take videos or artwork down so please do not flip my art to make it go against copyright radars! ToT I will cry!

  • You may edit / trace personal art for practice / headcanons / edits / memes as long as i'm given visible credit.

Please don't:

  • Don't edit / trace my SFW art for NSFW purposes. I do not draw NSFW and altering my art to make it look like I do gives people the wrong idea of what my content is about and may request to take it down.

  • Use my artwork for advertising, promotion, branding, advocacy or political or ideological messaging and any other purpose intended to communicate or endorse a message.

  • Steal my artwork or designs or monetize it for profit. (ex: selling merch, tracing to resell it as ych's etc...)

  • Any form of my art or part of it may NOT be used for NFT or any service / product / transaction related to NFTs. You may not reproduce or alter the image in any way, no matter how unrecognizable it may become, for use in any NFT related purposes.

  • Use my artwork in any kind of generative AI.

ART MADE SPECIFICALLY FOR YOU

  • Unless specified otherwise before starting the commission, I reserve the right to post WIPs, speedpaints or the finished artwork on my social medias for advertising purposes and exclusive content.

  • I reserve the right to stream, record, and upload videos of the creation of the artwork.

  • Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.

  • The product is strictly for your personal use only unless agreed otherwise.

You may use or edit the commissioned work in the following ways:

  • You may use the artwork for personal any kind of personal use (for example profile pictures, banners, wallpapers, site decorations, personal stickers, etc etc), provided the artwork was created for myself and credit is given.

  • Edit the artwork in any way you desire as long credit is still given.

  • Post the artwork on social media, with credit.

  • View, edit, redestribute (for free & credit) the files.

You may NOT use or edit the commissioned work in the following ways:

  • Use my artwork for advertising, promotion, branding, advocacy or political or ideological messaging and any other purpose intended to communicate or endorse a message.

  • Color in / commission other artists to color my sketches or lineart / commission another artist to finish and touch up the product I've made unless i've been contacted about it beforehand. I'm generally okay with it, though!

  • Reproduce the work commercially without purchasing a license.

  • Use the artwork for NFTS and generative AI.

IV. BOUGHT DESIGN TERMS OF SERVICE

Note that once you've bought a design from me, you have full permission to use that character however you please as the copyright no longer belongs to me.

You're free to:

  • Freely trade / resell / gift any design for any reason.

  • Resell for a higher price than bought for.

  • Edit the design you've received as you'd like.

  • Even if it's either a redesign or a small change, the character must be credited to me as the original designer.

  • Edit or add a story as you'd like

  • Use them for any personal projects.

  • Co-own the design with someone else.

  • You are allowed to replicate pieces of the design if you want to create a character related to them for world building purposes.

  • However, if you plan on reselling, I ask to that they must be all sold together. You may not keep any of the designs.

  • Turn a design into a fandom OC.

Do not:

  • Make breedables using my designs.

  • Turn any of my designs into closed or open species unless agreed to.

| COMMISSION & ORDERING PROCESS |

V. WHAT I CAN DRAW AND WON’T DRAW

I am allowed to refuse to draw a characters based on my lack skills or what makes me uncomfortable.
If I mess up or get the pattern wrong of one of your characters, it's on me, so please don't be afraid to ask for a fix! I won't charge you anything!

I can draw & I can try

  • Most original characters:
    Canon characters | fan characters | domestic pets | animals creatures, etc

  • Any of my characters: I can include any of them in the commission for free ^^

  • Mild gore | mild body horror | cartoony gore | realistic organs as props

  • Any type of positive representation

  • Any body type

  • Nudity* (except male genitalia)

  • Mild sexual undertones

  • Buff characters and muscles, intricate anatomy

  • Structures

  • IRL people

  • Simple / mild Mecha

I won't draw

  • NSFW*:
    sexual intercourse or the implication of it, aroused genitalia.

  • NSFL:
    Extreme gore | violence | abuse | torture | children being hurt in some way

  • Characters with fresh self harm cuts (scars are fine), romanticization of illnesses / disorders | serious topics

  • Art that contains any hate towards a group of people or minority | art containing slurs | political propaganda

  • Any kind of proship art or art that engages in zoophilic / necrophilic / pedophilic acts

  • Art in someone else’s style

  • Realistic characters and portraits

  • Tattoo designs

About nsfw*:
I'm uncomfortable with drawing explicit nsfw and sexual acts. I am fine with drawing suggestive artwork as long it's not overly explicit.

VI. PAYMENT & FEES

  • Payment is expected after 24 hours unless discussed. It must be paid upfront.

  • If discussed, it's possible to do 50/50. Upfront gains a commission priority, the 50/50 may take a bit more of time to be finished and the full final product may be sent only when money has been received.

  • Never send payment without my approval first.

  • A design fee will be charged for clients with no reference images that would like me to draw solely from a description and/or a collection of photos.

  • Additional fees will be charged for excessive or major revisions (see “Revisions” below).

CANCELLATION AND REFUNDS

  • If you wish to cancel the commission before payment, there are no repercussions. The commission will be cancelled and no further action needs to be taken.

  • Asking for a refund when the art piece is completed is not allowed.

  • If you want a refund but the art is still not completed, i'll only charge for what i've done that far.

  • I have the rights to not finish a commission if I really need to. Of course, i'll give a refund then.

  • I have the rights to stop a commission if the client doesn't send payment, details (such as references) in a certain amount of time. Ghosting / Ignoring messages when I ask for information may also lead to the commission being stopped. (If you have anxiety I totally understand! Please let me know, and I'll be less pushy!)

  • I have the rights to reuse and sell the pose and concept as a Ych to someone else if a refund is requested and the illustration has not been completed.

  • Inappropriate/aggressive behaviour of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, I may stop or cancel the commission. (+ refund if you paid me.)

VII. Client obligations

  • Carefully read through the ToS and Commission Information.

  • Be aware that I am a disabled artist with health problems and it may take a while before finishing your commission.

  • Write in a clear and concise manner when filling out the commission form. Provide multiple clear reference images of the character/subject. I have a somewhat severe form of aphantasia, so the more you specify in your form and the more you'll help me visualize what you have in mind. You can leave some things up to me though.

  • Mood boards, links, moodboards, quick sketches, 3d poses, anything that can help are welcome!

  • Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.

VIII. PROCESS & WORK SCHEDULE

  • Resolution of the art will change depending on my needs. If needed I can accept custom heights and lengths, as long they’re not too big for my devices to handle.

  • I have the right to use assets such as 3D models, brushes and background elements that could help me speed up the process.

  • I have the rights to re-use ych assets.

  • I will send over a sketch for approval before continuing the commission. I will accept one complete revision at the sketch stage.

  • Sketch and subsequent in-progress shots will initially be sent as low-res, watermarked images if I didn't receive full payment yet.

  • I won't accept drawings with deadlines. We can discuss about it but i'll probably refuse as it causes me too much stress.

  • I will always do my best to complete your commission within a timely manner, but please understand that sometimes life may get in the way and cause a delay in completing your commission, especially because I suffer from a chronic fatigue and other health problems. I will notify you as soon as possible of any issues that come up to keep you informed.

  • Color changes to the characters may be applied in my final product. Example: with darker oc’s, I would need to light them up a little bit because it’d help me with shading if needed. (anything close to pitch black, a dark skin tone is totally fine!) This also applies to extremely neon colors too, and i'd need to unsaturate them a little bit. I could also slightly change the palette with filters to make the overall drawing look nicer.

The commissioner will receive:

  • Commissioned work (With / without watermark

  • Sketches

  • Alt versions (Transparent & different lighting / backgrounds if I have any)

  • If requested, a psd file with the whole process + captions.

  • If requested, a speedpaint of the whole process.

IX. REVISIONS

  • One major revision is allowed in the sketch phase and is covered in the commission price.

  • A limited amount of minor revisions are allowed in coloring/painting stage and are covered in the commission price.

  • I won't change the pose of the drawing if you don't ask for a specific one from the beginning.

  • Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.

  • Revisions due to my own negligence are free.

  • Revisions due to my ignorance on a certain topic are also free.

  • I may ask for additional details if in the drawing process I'm not sure on how to draw something with the references presented. If you ignore my message or take to long to reply, I may continue the drawing with the best of my understanding. Revisions then will incur additional fees depending on what it is.

  • Additional major revisions will incur additional fees.

  • It is up to my discretion as to what constitutes minor and major revisions.

| PURCHASABLE CONTENT |

With purchasable content I'm referring to subscriptions and paid downloadable content.

You're allowed to:

  • Use brushes for your personal and commercial work.

  • Give credit to me.

You're NOT allowed to:

  • Under any circumstances you may not redestribute any of the content you've paid for, including to friends and family.

  • Claim your work as your own.

BLACKLIST

I have the right to share my blacklist for informing other artists.
I will not go out with public explanations nor am I obligated to, this is for people's safety and to avoid further conflicts. You may ask privately for context but I am neither obligated to explain nor keen on telling just for the curiosity of others.
Only ask if you are genuinely concerned and wish to stay safe/aware.So far there's no one in my blacklist so let's keep it that way :)

CHANGELOG

The updated terms of service only affect purchases made after the specified date. If I revise the terms at a later date but your commission predates that, the changes won't affect you.
